1. Overview
Fill Finder, LLC ("Fill Finder, LLC," "we," "us," or "our") operates a marketplace website that connects people or businesses who need construction and landscaping material with contractors, suppliers, and other providers who have material available. By creating an account, posting a listing, or otherwise using Fill Finder, you agree to these Terms and Conditions.
2. Fill Finder, LLC Is Not a Party to Any Transaction
Fill Finder, LLC is a listing and communication platform only. We do not provide, transport, deliver, purchase, sell, inspect, test, certify, or take possession of any material. Any agreement to provide, deliver, or accept material is solely between the material recipient and the material provider (contractor, supplier, or other user).
3. No Material Quality Guarantee
Fill Finder, LLC does not inspect, test, certify, or guarantee material listed through the platform. Material type, quality, suitability, composition, quantity, and condition must be verified directly between the material provider and recipient before delivery. Photographs shared through the platform are provided by users and contractors for informational purposes only and do not constitute verification or certification by Fill Finder, LLC.
4. A Listing Is Not Permission to Deliver
A live Fill Finder, LLC listing does not constitute permission to dump or deliver material. Users must always contact the other party and confirm material type, quantity, timing, access, and delivery location before transporting or unloading any material. Users are solely responsible for complying with applicable local, state, and federal laws and regulations, including those governing clean fill, waste disposal, and environmental protection.
5. Prohibited Material
Fill Finder, LLC is intended for ordinary construction and landscaping materials such as clean fill, topsoil, clay, sand, gravel, crushed concrete, limestone, rock, mulch, and wood chips. Users may not list or knowingly accept trash, household garbage, hazardous waste, petroleum-contaminated soil, chemical waste, asbestos-containing material, or other regulated or contaminated material. Fill Finder does not determine whether any material legally qualifies as clean fill.
6. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate contact information. Contractor accounts are currently free; Fill Finder, LLC may introduce paid features in the future, which will be clearly disclosed before purchase.
7. Marketing Communications
By creating an account, you consent to receive marketing emails from Fill Finder, including promotional messages, marketplace activity near your area, and advertising from Fill Finder, LLC or its contractor/supplier partners. You may unsubscribe from marketing emails at any time using the link provided in those emails; you may still receive non-marketing transactional messages related to your account and listings.
8. Payments
Paid Fill Finder, LLC listings are processed securely through Stripe. Fill Finder, LLC does not store full payment card numbers. Any price for material itself, including delivery or trucking charges, is negotiated directly between the material recipient and the contractor or provider. Fill Finder, LLC is not a party to that negotiation, does not set or collect the material price, and does not guarantee the terms of that arrangement. Fill Finder, LLC may charge a separate platform or listing fee, which will be clearly displayed before you complete a purchase.
9. Limitation of Liability
Fill Finder, LLC is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Fill Finder, LLC is not liable for any damages, losses, or disputes arising from material quality, delivery, transportation, property damage, personal injury, environmental harm, contamination, grading or drainage problems, trespass, inaccurate listing information, delays, lost profits, or any transaction or interaction between users. This includes damage to land, buildings, driveways, utilities, landscaping, roads, vehicles, equipment, crops, or other property.
10. User Responsibility and Indemnification
Users are solely responsible for investigating, testing, accepting, loading, transporting, placing, spreading, and using material; confirming ownership and permission to access or alter a site; protecting underground and overhead utilities; obtaining permits; and complying with all applicable laws, environmental rules, and land-use requirements. Users must inspect material and the site before delivery and must stop work if material appears contaminated, hazardous, unsuitable, or different from what was represented. You agree to defend, indemnify, and hold harmless Fill Finder and its owners, employees, contractors, and service providers from claims, damages, fines, costs, and expenses, including reasonable attorneys' fees, arising from your listing, communications, conduct, material, vehicle, delivery, site work, breach of these Terms, or violation of another person's rights.
11. Changes to These Terms
We may update these Terms and Conditions from time to time. Continued use of Fill Finder after changes take effect constitutes acceptance of the revised terms.
